Terms of Service

1. Agreement to Terms

By accessing or using Foundry (“the Service”), operated by Intrigue MMC LLC (“we”, “us”, “our”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Foundry is an operating system for builders. It helps you capture ideas, triage opportunities, track decisions, manage projects, and review progress. The Service is provided on a subscription basis with Free and Pro tiers.

3. Account Registration

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate, current, and complete information during registration.

4. Subscription and Billing

The Pro plan is billed monthly or annually via Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis. You may cancel at any time through the billing settings; cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.

We reserve the right to change pricing with 30 days' notice. Price changes will take effect at the start of the next billing cycle following the notice period.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to the Service or its systems
  • Interfere with or disrupt the Service or its infrastructure
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use automated means to access the Service without our prior written consent

6. Your Data

You retain ownership of all data you enter into the Service. We do not sell your data to third parties. We use your data only to provide and improve the Service. You may export your data at any time (Pro and Pro plans) and request deletion of your account and associated data.

7. AI Features

Pro plan features include AI-powered analysis (triage scoring, decision review, weekly summaries, idea expansion, founder briefings, and pattern detection). AI features are subject to monthly usage limits that reset on the 1st of each month. Current limits per feature are displayed on the pricing page and billing settings. We reserve the right to adjust these limits with 30 days' notice.

AI outputs are generated suggestions and should not be relied upon as professional advice. We use third-party AI providers (Anthropic) to process your data for these features. Your data is not used to train AI models.

8. Limitation of Liability

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

9. Termination

We may suspend or terminate your access to the Service at any time for violation of these terms, with reasonable notice where practicable. Upon termination, your right to use the Service ceases immediately. You may request a data export before your account is permanently deleted.

10. Changes to Terms

We may update these terms from time to time. We will notify you of material changes via email or a prominent notice in the Service. Your continued use of the Service after changes take effect constitutes acceptance of the revised terms.
